10.- What are your Rights and how Can You Exercise Them?

Data protection regulations allow you to exercise your rights of access, rectification, opposition, suppression, limitation of processing, portability, and not to be subject to individualized decisions before SICOR.

These rights are characterized by the following:

  • Their exercise is free of charge
  • If the requests are manifestly unfounded or excessive (for example, repetitive), SICOR may:
    • Charge a fee proportional to the administrative costs incurred.
    • Or refuse to act.
  • Requests must be answered within one month, although, taking into account the complexity and number of requests, the deadline may be extended for another two months.
  • SICOR is obliged to inform you about the means to exercise these rights. These means must be accessible, and this right cannot be denied for the sole reason that you opt for another means.
  • If the request is submitted by electronic means, the information will be provided by these means when possible, unless the interested party requests otherwise.
  • If SICOR does not act on the request, it will inform you, at the latest within one month, of the reasons for its inaction and the possibility of filing a claim with a Control Authority.
  • You can exercise your rights directly or through your legal representative.

Below, we explain what the rights that assist you consist of:

  • The right of access allows you to contact SICOR to find out if it is processing your personal data or not.
  • The right of rectification allows you to obtain the rectification of your inaccurate personal data without undue delay from SICOR. Taking into account the purposes of the processing, you have the right to have incomplete personal data completed, including by means of an additional declaration. In your request, you must indicate which data you are referring to and the correction that needs to be made. In addition, when necessary, you must accompany your request with documentation that justifies the inaccuracy or incompleteness of your data.
  • The right of opposition, as its name indicates, means that you can oppose SICOR processing your personal data in the following cases:
    • When they are subject to processing based on a mission of public interest or legitimate interest, including the creation of profiles.
    • When the purpose of the processing is direct marketing, including the aforementioned creation of profiles.
  • The right of suppression can be exercised before SICOR requesting the suppression of your personal data when any of the following circumstances occur:
    • If your personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed.
    • If the processing of your personal data has been based on the consent you gave to SICOR, and you withdraw it, provided that the aforementioned processing is not based on another cause that legitimizes it.
    • The processing of SICOR was based on legitimate interest or on compliance with a mission of public interest, and no other reasons have prevailed to legitimize the processing of your data.
    • If your personal data has been the subject of direct marketing, including the creation of profiles related to the aforementioned marketing.
    • If your personal data has been processed unlawfully.

However, this right is not unlimited, in such a way that it may be feasible not to proceed with the suppression when the processing is necessary for the exercise of freedom of expression and information, for compliance with a legal obligation, for compliance with a mission carried out in the public interest or in the exercise of public powers conferred on the controller, for reasons of public interest, in the field of public health, for archival purposes in the public interest, scientific or historical research purposes or statistical purposes, or for the formulation, exercise or defense of claims.

SICOR will be obliged to block your data when it proceeds to its rectification or suppression.

The blocking of data consists of the identification and reservation of the same, adopting technical and organizational measures, to prevent its processing, including its visualization, except for making the data available to judges and courts, the Public Prosecutor’s Office or the competent Public Administrations, in particular the data protection authorities, for the exigency of possible responsibilities derived from the processing and only for the limitation period of the same.

After that period, the data must be destroyed.

  • The right to limitation of processing consists of obtaining the limitation of the processing of your data carried out by SICOR, although its exercise has two aspects: You can request the suspension of the processing of your data:
    • When you challenge the accuracy of your personal data, for a period that allows the controller to verify it.
    • When you have opposed the processing of your personal data that SICOR carries out based on legitimate interest or mission of public interest, while SICOR verifies if these reasons prevail over yours.
    • Request SICOR to keep your data:
    • When the processing is illegal and we have opposed the suppression of your data and instead you request the limitation of its use.
    • When SICOR no longer needs the personal data for the purposes of the processing, but you need them for the formulation, exercise or defense of claims.
  • The right to portability: The purpose of this new right is to further reinforce the control of your personal data, so that when the processing is carried out by automated means, you receive your personal data in a structured, commonly used, machine-readable and interoperable format, and you can transmit them to another controller, provided that the processing is legitimized based on consent or within the framework of the execution of a contract.

However, this right, by its very nature, cannot be applied when the processing is necessary for compliance with a mission of public interest or in the exercise of public powers conferred on the controller.

In order to exercise your rights, SICOR makes the following means available to you

  • By means of a written and signed request addressed to the Data Protection Delegate of GRUPO SICOR, calle Maestro Alonso 22, 28028, Madrid.

By means of a written and signed request addressed to the email address of the Data Protection Delegate of GRUPO SICOR, dpd@gruposicor.com
